Chapter General Provisions

The article is to continue to promote the conversion of new and old kinetic energy, promote the green and low-carbon development of the province, complete the “dual control” of total energy consumption and intensity, and control the total coal consumption target, and standardize the management of energy and coal consumption reduction in fixed asset investment projects. “Energy Conservation Law of the People’s Republic of China”, “Air Pollution Prevention and Control Law of the People’s Republic of China”, “Interim Measures for the Substitution of Coal Consumption Reduction in Key Areas”, combined with the “Shandong Province Energy Conservation Regulations”, and the General Office of the People’s Government of Shandong Province on strengthening the “Two Highs” “Project Management Notice” and other relevant regulations, formulate these measures.

Article 2 These Measures are applicable to fixed asset investment projects involving energy consumption and direct coal consumption within the administrative area of Shandong Province (hereinafter referred to as energy-consuming projects and coal-consuming projects).

The direct consumption of coal as mentioned in these Measures refers to the use of raw coal, clean coal, other washed coal, coal water slurry, briquette, pulverized coal, coal slime, etc. as fuel or raw materials for combustion or production processing, and its coal-consuming equipment ( Facilities, tools) mainly include boilers, kilns, gasifiers, iron-making blast furnaces, organic heat carrier furnaces, furnaces, etc.

The term “fixed asset investment projects” as used in these Measures refers to new, rebuilt, and expanded projects that require the approval, approval, and filing of investment directors or administrative approval departments at all levels in accordance with regulations.

Article 3 Energy and coal consumption reduction substitution refers to the newly added energy and coal consumption of the proposed project. Alternative sources need to be implemented by other means to reduce energy and coal consumption. Alternative sources include:

(1) Energy and coal consumption reduced by the company’s shutdown and conversion;

(2) Eliminating outdated production capacity, reducing excess production capacity, or energy and coal consumption reduced by energy-saving technological transformation;

(3) Where clean energy such as renewable energy, natural gas, and electricity is used to replace coal consumption, the amount of substitution may be used as an alternative source of coal consumption;

(4) Energy and coal consumption reduced through other means.

Article 4 Alternative source requirements:

(1) The reduction in energy and coal consumption by industrial enterprises above designated size has been included in the statistics;

(2) The reduction in energy and coal consumption resulting from the adoption of the above methods after January 1, 2021;

(3) When the actual energy and coal consumption of the proposed project is formed, it shall be implemented simultaneously;

(4) The reduction in energy and coal consumption formed in the administrative region of Shandong Province.

Article 5 The proposed projects shall be classified in accordance with the industry, the replacement standards shall be determined, and the energy and coal consumption reduction replacement system shall be strictly implemented.

The formula for calculating the replacement amount of energy and coal consumption is: Q=A×H×J

Among them, Q refers to energy and coal consumption substitution, A refers to the new comprehensive energy consumption or new coal consumption in the planned project design, H refers to the industry coefficient, and J refers to the regional coefficient.

Article 6 According to the industry to which the fixed asset investment project belongs, determine the reduction substitution coefficient of different industries.

(1) Energy consumption reduction and substitution

1. All the “Notice on Strengthening the Management of the “Two Highs” Projects” clearly specify that the “two highs” proposed projects need to implement energy consumption reduction and substitution.

2. Industry factor: The industry factor H of cement, refining and chemical, electrolytic aluminum, and coal power projects is 1.5; steel, coking, ferroalloy, calcium carbide, lime, methanol, nitrogen fertilizer, acetic acid, chlor-alkali, building ceramics, flat glass, asphalt waterproof materials, The industry coefficient H of the back pressure cogeneration project is 1.2.

3. The projects that need to implement energy consumption reduction and substitution, and the source of substitution must come from the “two highs” industry projects.

(2) Substitution of coal consumption reduction

For all proposed coal-consuming projects, the coal consumption substitution industry coefficient H is 1.2. For projects using blue charcoal, refer to coal-consuming projects and implement coal consumption reduction alternatives.

Article 7 According to the regional evaluation results of the comprehensive evaluation of unit energy consumption output benefit in the new year, determine the coefficient J of different regions.

Among them, the areas where the comprehensive evaluation results of the unit energy consumption output benefit are classified as A and B, the area coefficient J is 1; the areas where the area evaluation results are classified as C and D in the comprehensive evaluation of unit energy consumption output benefit, regions The coefficients J are 1.05 and 1.1 respectively; the regional evaluation results are subject to the comprehensive evaluation results of the new year’s unit energy consumption output benefits.

Article 8 According to the requirements of energy saving and coal reduction work, in accordance with the principle of differentiated treatment and strict control, the coefficient of the energy and coal consumption substitution industry of the proposed project shall be adjusted in a timely manner.

Chapter II Reduction Alternatives

Article 9 The construction unit of the proposed project shall, according to the industry and region to which the project belongs, formulate alternative plans for reducing energy and coal consumption.

Article 10 The alternative plan for energy and coal consumption reduction shall include the following contents:

(1) Basic information of the project construction unit;

(2) The basic information of the project, including the industry, construction site, construction scale, construction content, construction progress, total investment, etc.;

(3) Project construction plan, product plan, process and equipment situation, main energy and coal consumption equipment and facilities;

(4) The energy and coal consumption of the project, including the type, quantity, and various parameters of the energy and coal used;

(5) Calculation methods and basis for energy and coal substitution;

(6) Energy and coal reduction alternative sources, replacement quantity and implementation measures. Among them, coal consumption reduction substitution and energy consumption reduction substitution for coal-consuming projects shall be listed separately in two chapters;

(7) Conclusion and suggestions;

(8) Attachments, including the summary table of alternative sources, the proof of the integration of alternative sources and quantities, the authenticity of alternative sources and non-repetitive substitution commitments, and other relevant materials, including coal consumption reduction alternatives and energy consumption reduction alternative sources for coal-consuming projects The summary table should be listed separately.

Article 11 The reduction in energy and coal consumption from alternative sources shall be scientifically calculated based on different alternative approaches.

(1) The reduction in energy and coal consumption caused by the elimination of outdated production capacity, reduction of excess production capacity or other reasons caused the company to shut down and exit as a whole, and the resulting reduction in energy and coal consumption shall be calculated according to the average value of the three years before the company shut down;

(2) Elimination of backward production capacity, reduction of excess production capacity or other reasons caused the company to shut down and dismantle some energy and coal consumption equipment and facilities, resulting in reductions in energy and coal consumption. According to the company’s energy statistics, verify the equipment and facilities before shutting down The actual consumption in 3 years is calculated based on the average value;

(3) The reduction in energy and coal consumption resulting from the enterprise’s energy-saving technological transformation shall be calculated according to the consumption difference before and after the technological transformation;

(4) According to statistical data, the actual coal consumption in the three years before the replacement is verified and calculated based on the average value of the coal consumption reduction caused by the implementation of clean energy replacement;

(5) The new coal consumption and coal substitution of the proposed coal-consuming projects are calculated based on the actual amount.

Chapter III Management Process

Article 12 Review of alternative plans for energy and coal consumption reduction, and implement territorial management.

For projects approved, approved by the National Development and Reform Commission and submitted to the State Council for approval and approval, and approved and approved by the National Development and Reform Commission, as well as projects approved, approved, and filed by the provincial-level investment authority, their energy and coal consumption reduction alternative plans are reviewed by the municipal energy The department responsible for the “dual control” of consumption and total coal consumption control.

For projects approved, approved, and filed by investment supervisors or administrative approval departments at the city, county (district) level, the energy and coal consumption reduction alternative plans are reviewed by the same level of energy consumption “dual control” and coal consumption total control authority.

Article 13 Contents of the review of alternative plans for energy and coal consumption reduction:

(1) Whether the plan is standardized and complete;

(2) Whether the calculation of the new comprehensive energy consumption and coal consumption of the project is scientific and accurate;

(3) Whether the substitute source is real and feasible, and whether the calculation of the substitute amount is scientific and accurate;

(4) Whether the relevant certification materials are complete and valid;

(5) Other content that needs to be reviewed.

Article 14 If energy and coal consumption reduction and substitution projects need to be implemented, the review opinions of the energy and coal consumption reduction substitution plan issued by the competent authority of the corresponding authority shall be obtained before the energy conservation review is handled.

For projects that are subject to energy conservation review at the provincial level, when the construction unit submits the relevant materials for energy conservation review to the Provincial Development and Reform Commission through the government service network, it also submits the review opinions of the energy and coal consumption reduction alternatives issued by the competent authority of the corresponding authority.

Article 15 If the energy and coal consumption increases after the energy conservation review, the energy conservation review agency shall send a letter to the competent authority for “dual control” of energy consumption and total coal consumption control at the project location, and the competent authority of the city, county (district) Upon receipt of the letter of inquiry, the construction unit shall be urged to implement the new alternative sources of energy and coal in accordance with the requirements of these Measures, and amend the energy and coal consumption reduction alternative plan, and provide a reissued energy and coal consumption reduction alternative plan in response to the letter Review opinions.

Article 16 If energy and coal consumption increases due to adjustments in the construction content of the project, the project construction unit shall implement the new alternative sources of energy and coal in accordance with the requirements of these Measures before the actual energy and coal consumption of the project is formed, and compile energy And coal consumption reduction alternative supplementary plan, submitted to the original alternative plan review department for review.

Article 17 The review opinions of the proposed energy and coal consumption reduction alternative plan for the proposed project shall be submitted to the original alternative plan review agency if the project has not started construction within 1 year from the date of issuance, and construction needs to be postponed, 30 working days before the expiration of the time limit postpone. The alternative plan review authority shall, within 20 working days from the date of accepting the application, make a decision on whether to agree to the extension of the alternative plan and issue corresponding documents. The alternative plan can only be postponed once, and the period shall not exceed 1 year.

Chapter IV Supervision and Inspection

Article 18 Investment supervisors and administrative examination and approval departments at all levels shall strengthen the examination and supervision and management of various investment projects, and shall not approve projects that have not implemented energy and coal consumption reduction alternatives; and shall not approve projects that have not implemented energy and coal consumption reductions. Any approved and record-filing projects that substitute for consumption reduction shall not start construction.

Article 19 The competent departments for “dual control” of energy consumption and total coal consumption control at all levels shall strengthen supervision during and after the event to ensure that alternative plans for project energy and coal consumption reduction are in place. Within one month after the actual energy and coal consumption of the proposed project is formed, the project unit must submit an acceptance application to the original alternative plan review department, and the original alternative plan review department will organize the acceptance and form an acceptance report.

Article 20 If the project construction unit passes the review by repeated substitutions, providing false materials and other improper means, the original alternative plan review department shall revoke the review opinions, announce the relevant information to the public, include it in the record of dishonesty, and deal with it seriously in accordance with laws and regulations.

Article 21 Third-party organizations shall, in accordance with the principle of objectiveness and fairness, earnestly carry out the preparation, review, and verification of alternative plans for energy and coal consumption reduction. For third-party institutions that violate laws and regulations in preparation, review, and verification, the review authority records the violation information of the third-party institutions, incorporates the violation information into the credit information sharing platform, and imposes strict administrative penalties in accordance with laws and regulations .

Article 22 If the staff responsible for the review and supervision of project energy and coal consumption reduction substitutions are involved in acts of favoritism, malpractice, abuse of power, negligence of duty, etc., they shall be held accountable in accordance with laws and regulations.

Chapter 5 Supplementary Provisions

Article 23 These management measures shall be implemented from June 21, 2021, and shall be valid until December 31, 2025. The original “Notice of Shandong Provincial Development and Reform Commission on Printing and Distributing the Alternative Management Measures for Coal Consumption Reduction of Coal Consumption Projects in Shandong Province” (Lu Fagai Huanzi [2018] No. 671) shall be repealed at the same time.
