Brazil initiates the third anti-dumping sunset review investigation against Chinese magnesium particles

On July 21, the Brazilian Foreign Trade Secretariat issued Announcement No. 48 of 2021 in the Federal Government Gazette, stating that, in response to the application submitted by the Brazilian domestic company Rima Industrial SA on March 21, 2021, the content of magnesium originating in China is ≥90. %. Magnesium particles with a lime content ≤10% initiated the third anti-dumping sunset review investigation. The Mercosur tax codes of the products involved are 8104.30.00 and 8104.90.00. The dumping investigation period in this case is from January 2020 to December 2020, and the damage investigation period is from January 2016 to December 2020. Except for another extension (maximum of 2 months), the final decision will be made within 10 months. The announcement takes effect from the date of issuance.
On April 29, 2003, Brazil initiated an anti-dumping investigation on magnesium particles originating in China. On October 11, 2004, Brazil made an affirmative final ruling on anti-dumping in the case and decided to impose an anti-dumping duty of US$0.99/metric ton on the Chinese products involved in the case. Since then, Brazil has successively carried out two anti-dumping sunset reviews on Chinese magnesium particles. On October 9, 2009 and October 7, 2015, two affirmative rulings were made and the tax collection period was extended.
